By using the Durham Elite Property Management website or engaging us for property management services, you agree to these terms. Please read them carefully.

1. Services We Provide

Durham Elite Property Management is a North Carolina-licensed property management firm offering:

  • Tenant placement and screening (TMLS marketing, Equifax credit and background checks, lease preparation)
  • Property maintenance coordination and four annual on-site inspections
  • Rent collection, financial reporting, and 24/7 owner-portal access via Buildium
  • Eviction services through the NC summary ejectment process
  • Investment property services including free rental analysis and Realtor referrals

The full scope of services for a managed property is defined in your individual property management agreement, which supersedes any general description on this website.

2. Use of This Website

This website is provided for informational purposes about our services. You agree not to use the site for any unlawful purpose, to interfere with site security, or to scrape content for commercial use without our written permission.

3. Free Rental Analysis

Free rental analyses are non-binding estimates based on TMLS comparable rentals and the property details you provide. Actual rental income depends on market conditions, property condition at listing, marketing execution, and tenant qualification — none of which can be guaranteed in advance.

4. Tenant Screening and Fair Housing

All tenant applications are processed under the federal Fair Housing Act and North Carolina state additions. Our screening criteria — 635 minimum credit score, 55% maximum debt-to-income ratio, zero tolerance for prior evictions, collections, charge-offs, or judgements — are applied consistently to every applicant. Race, color, national origin, religion, sex, familial status, disability, and other protected classes are never factors in our decisions.

5. Pricing and Fees

Specific fees, including the percentage management rate and any optional add-ons such as eviction-protection coverage, are set in your individual property management agreement. The standard one-time owner transfer fee is $499. Pricing displayed on this website is illustrative and may change without notice; contractual fees will not change without an amendment signed by both parties.

6. Maintenance Approval Threshold

Routine maintenance and emergency triage are handled by our coordinator using vetted local contractors. Repairs above the threshold defined in your management agreement require your written approval before work begins, except for true safety emergencies, where we will proceed and notify you within minutes.

7. Eviction-Protection Coverage

Eviction-protection coverage, when purchased as an add-on, absorbs the legal-process costs of a NC summary ejectment filing through to sheriff lockout for a covered tenant. Specific coverage limits and exclusions are set in your management agreement.

8. NC Real Estate Licensing

Durham Elite Property Management operates under licensed North Carolina Real Estate Agents in compliance with the North Carolina Real Estate Commission. We are members of the Triangle Multiple Listing Service (TMLS) and operate as Equal Housing Opportunity providers.

9. Limitation of Liability

To the maximum extent permitted by NC law, Durham Elite Property Management is not liable for indirect, incidental, special, or consequential damages arising from use of this website or from property management services. Our liability for direct damages from management services is limited to the management fees paid by you in the twelve months preceding the claim.

10. Intellectual Property

All content on this website, including text, graphics, and the Durham Elite brand, is the property of Durham Elite Property Management and is protected by U.S. copyright and trademark law.

11. Governing Law

These terms are governed by North Carolina law. Any dispute arising from these terms or our services will be resolved in the state or federal courts of Durham County, North Carolina.

12. Changes to These Terms

We may update these terms as our services evolve or as required by law. The "Last updated" date at the top reflects the most recent change. Continued use of the website constitutes acceptance of the updated terms.
